BACKGROUND:

Commissioner Spaulding absent.

70 Connect ii, built by Lauth Group of Carmel, was found non-compliant in 2025 with CF1 filings required for tax abatement requirements. 

An Estoppel Certificate is a legal document used in commercial real estate.  Gives landlords, investors, investors and lenders additional security that the tenant’s promises will be kept. They also benefit tenants as the document confirms that the landlord will not change any agreed-upon terms to the commercial lease.

SUMMARY OF SIGNIFICANT AGENDA ITEMS AND KEY POINTS:

1.    70 Connect ii current owner Lauth Group plans to sell the warehouse to a Texas company, Hillwood.  They request an Estoppel Certificate to terminate their loan agreement and EDA with the county, since they will no longer be the owners.  Required to proceed with the sale. New owner plans to retain the current tenant, a logistcs company.  Previously approved by the Redevelopment Commission.

Approved by the Commissioners.

2.   Detailed budget, resources and usage for HC Public Library and Mt. Vernon Public Library.  Plan for new McCordsville branch.

3.   Sewage Projects.  Presented by owner Lana Beregszazi of BCS, a firm that provides non-engineering and non-legal services to communities that are transitioning to sanitary sewers.  Presented the environmental and health advantages.   Focus on community engagement, prioritizing which communities to connect, determining which utility will provide the service and developing strategies to reduce the cost burden to residents.  Priority has been assigned to three communities:

a.   New Palestine:  500 homes outside the town limits that currently have septic systems to be considered for connection to wastewater treatment.  $150 K

b.   Charlottesville.  Beyond malfunctioning septic systems, certain residences also discharge wastewater directly into ditches and streams.  $80K

c.   Maxwell.  Due to failing septic systems, E.Coli frequently contaminates the well water that supplies the school. $275K

Discussed creative funding strategies for the county, including SRF (State Revolving Fund).  On agenda for next Council meeting.  Action:  Will make decision based on Council feedback and when Commissioner Spaulding is present.

4.   Save Hancock Co. LLC

Presenters Paul Overhauser, Leah Lederman and Kiley Blalock provided research on data center community impacts and request for 1 year pause in data center development in Hancock County.  This will allow the Plan and Zoning commissions to study and make recommendations.

Action:  Commissioners will take under review.
